This privacy notice aims to give you information on how Tebex Limited collect and process your personal data through your use of www.tebex.io and www.buycraft.net (together “this website”), and also any third-party webstore (a “Webstore”) which utilises the Tebex webstore platform for game servers (the “Tebex Platform”), including any data you may provide through this website when you purchase a product or service.

This website is not intended for children and we do not knowingly collect data relating to children. It is our policy to encourage all minors to consult with their parents or legal guardian before submitting any content or information to us, our commercial partners or other third parties.

2. The data we collect about you

• Identity Data - first name, last name, and username or similar identifier.
• Contact Data - billing address, delivery address, email address and telephone numbers.
• Transaction Data - details about payments to and from you and other details of products and services you have purchased from us.
• Technical Data - IP address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform.
• Profile Data - your username and password, purchases or orders made by you, and any account preferences.
• Usage Data - information about how you use our website, products and services.
• Marketing and Communications Data - your preferences in receiving marketing and your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as it does not directly or indirectly reveal your identity. We do not collect any Special Categories of Personal Data about you, nor any information about criminal convictions and offences.

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case we may have to cancel a product or service, but we will notify you at the time.

3. How is your personal data collected?

• Direct interactions - you may give us your Identity and Contact Data by filling in forms or corresponding with us, for example when you use our website or any Webstore, create an account, subscribe to updates, request marketing, contact us via social media, report a problem, or give us feedback.
• Automated technologies or interactions - as you interact with our website we may automatically collect Technical Data about your equipment, browsing actions and patterns using cookies, server logs and similar technologies.
• Third parties or publicly available sources - Technical Data from analytics providers such as Google and Cloudflare; Contact, Financial and Transaction Data from providers of technical, payment and delivery services such as Help Scout and Braintree.

4. How we use your personal data

We will only use your personal data when the law allows us to. Most commonly we rely on: performance of the contract we are about to enter into or have entered into with you; our legitimate interests (where your interests and fundamental rights do not override those interests); and compliance with a legal or regulatory obligation. Generally, we do not rely on consent as a legal basis other than in relation to sending third party direct marketing communications to you via email; you may withdraw consent to marketing at any time.

• To process and deliver your order, manage payments, fees and charges and recover money owed - Identity, Contact, Financial, Transaction, Marketing and Communications - performance of a contract and legitimate interests.
• To manage our relationship with you, including notifying you about changes to our terms or privacy policy and asking you to leave a review or take a survey - Identity, Contact, Profile, Marketing and Communications.
• To administer and protect our business and this website (troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting) - Identity, Contact, Technical.
• To gather and provide information required by audits, enquiries or investigations by regulatory bodies or law enforcement - Identity, Technical, Profile.
• To deliver relevant website content and advertisements and measure their effectiveness, to use data analytics to improve our services, and to make suggestions and recommendations to you.

Marketing: you will receive marketing communications from us if you have requested information or purchased goods or services from us and have not opted out. We will get your express opt-in consent before we share your personal data with any third parties outside the Tebex group of companies or our Webstore partner community for marketing purposes. You can ask us or third parties to stop sending marketing messages at any time via your marketing preferences, the opt-out links on any message, or by contacting us.

Cookies: you can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, some parts of this website may become inaccessible or not function properly. See https://www.tebex.io/legal/cookie.

Change of purpose: we will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another compatible reason. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so.

5. Disclosures of your personal data

• Internal Third Parties - other companies in the Tebex group of companies.
• External Third Parties - service providers, suppliers, professional advisers, and HM Revenue & Customs, regulators and other authorities.
• Specific third parties such as our Webstore partners and Amazon Web Services.
• Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes. We may share anonymised and aggregated data with advertising platforms, analytics providers and commercial partners; this data cannot be used to identify any individual.

6. International transfers

Many of our external third parties are based outside the European Economic Area (EEA), so their processing of your personal data will involve a transfer of data outside the EEA. Whenever we transfer your personal data out of the EEA we ensure a similar degree of protection by transferring only to countries deemed adequate by the European Commission, or by using Standard Contractual Clauses approved by the European Commission.

7. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator where legally required.

• Do not confirm your bank or credit card details in an email - we will never ask for such data this way.
• Keep your passwords private.
• When creating a password, do not use words such as your name or date of birth.
• Change your password regularly.

8. Data retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including satisfying any legal, accounting or reporting requirements. By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for up to 10 years after they cease being customers for tax purposes. In some circumstances we may anonymise your personal data for research or statistical purposes, in which case we may use that information indefinitely without further notice to you.

9. Your legal rights

• Request access to your personal data (a “data subject access request”).
• Request correction of the personal data that we hold about you.
• Request erasure of your personal data where there is no good reason for us continuing to process it.
• Object to processing where we rely on a legitimate interest, and at any time where we process your data for direct marketing.
• Request restriction of processing of your personal data.
• Request the transfer of your personal data to you or to a third party in a structured, commonly used, machine-readable format.
• Withdraw consent at any time where we rely on consent to process your personal data.

You will not have to pay a fee to access your personal data or to exercise any of the other rights, though we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. We may need to request specific information from you to confirm your identity. We try to respond to all legitimate requests within one month; occasionally it may take longer, in which case we will notify you and keep you updated.

10. Glossary

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract. Comply with a legal or regulatory obligation means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to. Aggregate Data means information derived from personal data but grouped and processed in a way that prevents identification of individuals.

11. MineSea store data and Stripe (Custom Pearls)

In addition to the Tebex notice above, the MineSea server operator processes a small amount of data for Custom Pearl orders, which are paid through Stripe rather than Tebex:

• Data we handle: your Minecraft username (and the resolved account UUID), the Pearl amount ordered, the amount paid, the Stripe checkout session/payment reference, and the delivery status of your order.
• Payment data: card and billing details are collected and processed by Stripe Payments Europe, Ltd. on Stripe's own hosted checkout. We never see or store your card number. See Stripe's privacy policy at https://stripe.com/privacy.
• Why: to take payment, deliver the Pearls you bought to your Minecraft account, provide support, and keep records for accounting and fraud prevention (performance of a contract and legitimate interests).
• Who else sees it: our backend (database and delivery queue) and the MineSea Minecraft server plugin, which fetches the pending delivery for your username over an authenticated connection.
• Retention: order and delivery records are kept for as long as needed for support, accounting and fraud prevention.
• Your rights: to access, correct or delete your MineSea store order data, email support@minesea.org.
• Cookies on this store: we use only functional storage needed for your cart, username entry and secret code entry. No advertising cookies are set by MineSea.
